Under California Law, the Family Law Courts are not required to grant spousal support automatically. An award of spousal support is based on the dozen criteria of Family Code § 4320. Which ones apply are case specific, including the following:

Earning capacity of each spouse;

Existence and enforceability of a premarital or postmarital agreement;

Extent to which each has contributed to the education / training of the other;

Health & age of each spouse;

Length of the marriage;

Level of education of each spouse;

Sources of income available to each spouse;

The standard of living enjoyed during the marriage.
